Services

MedArbId provides assistance to parties who wish to engage in ad hoc arbitration. We will appoint our qualified members as panel that can assist client in proceeding through the arbitration process in an attempt to achieve the most favourable resolution.

Our arbitrators have broad qualifications with extensive experience and expertise including on commercial laws, maritime laws, ship architecture, banking, insurance, and information technology, among others. Our arbitrators also received professional trainings and certification from international arbitration institutions.

Our Model Arbitration Clause

“Any dispute, controversy or claim relating to, connected with, or arising out of this Agreement, including any question regarding existence, validity, breach, or termination thereof, as well as any challenge to the tribunal’s jurisdiction shall be finally resolved by arbitration in accordance with the United Nations Commission on International Trade and Law (UNCITRAL) Arbitration Rules. The Appointing Authority shall be the Independent Academy for Independent Arbitrators and Mediators (MedArbId).”

Recommended additions:

  • The seat of arbitration shall be […];
  • The number of arbitrators shall be ... [one or three];
  • The place of arbitration shall be ... [town and country];
  • The language to be used in the arbitral proceedings shall be […];
  • This contract shall be governed by the substantive law of […].

Model Submission Clause

Parties wishing to substitute an existing arbitration clause for one referring the dispute to arbitration under the United Nations Commission on International Trade and Law (UNCITRAL) Arbitration Rules may adopt the following form of agreement:

“The parties hereby agree that the dispute arising out of the contract dated _____________ shall be settled by arbitration under the United Nations Commission on International Trade and Law (UNCITRAL) Arbitration Rules. The Appointing Authority shall be the Independent Academy for Independent Arbitrators and Mediators (MedArbId).”

This form may also be used where a contract does not contain an arbitration clause.
